Terms of Service

Agreement to Terms

By engaging Katahdin Digital Growth ("we," "our," or "us") for web design and hosting services, you ("Client") agree to the following terms and conditions. These terms govern the relationship between Katahdin Digital Growth and the Client for all services provided.

Services Provided

Katahdin Digital Growth provides custom website design, development, and hosting services for local service businesses. Our services include:

• Custom hand-coded website design and development
• Website hosting on Cloudflare's global network
• SSL certificate provisioning and maintenance
• Search engine optimization
• Structured data for AI search visibility
• Individual service page creation
• Ongoing content updates as requested

Pricing and Payment

Services are billed at $29 per month with no upfront costs and no contract. Payment is due on the same date each month, beginning on the date of website launch. We accept payment via credit card or debit card. Late payments may result in temporary suspension of hosting services after a 10-day grace period.

No Contract

There is no minimum commitment period. The Client may cancel at any time for any reason. There are no cancellation fees, early termination penalties, or long-term obligations of any kind.

Domain Name

If the Client does not already own a domain name, Katahdin Digital Growth will register and maintain a domain on the Client's behalf at no additional cost -- this is included in the monthly subscription. The domain is registered in the Client's name, and the Client is the legal owner of the domain at all times. Upon cancellation of services, the domain will be released to the Client with full transfer credentials provided. We will never hold a Client's domain hostage. If the Client already owns and manages their own domain, we will configure it to work with their website at no extra charge.

Cancellation

The Client may cancel services at any time. Upon cancellation:

• The website will be taken offline at the end of the current billing period
• No refunds are provided for the current billing period
• No further charges will be made

Website Ownership

Katahdin Digital Growth retains ownership of all website code, design, and associated files for the duration of the service agreement. The website is provided as a managed service. Upon cancellation, the Client does not retain rights to the website code or design unless a separate ownership transfer has been agreed upon in writing.

Content and Accuracy

Website content is built using information from the Client's publicly available online presence (Google Business Profile, social media, review platforms) and information provided directly by the Client. The Client is responsible for reviewing their website for accuracy and notifying us of any corrections needed. Customer reviews displayed on the website are reproduced verbatim from public review platforms and are limited to five-star reviews.

Content Updates

Content updates are included at no additional cost for the duration of the service agreement. Content updates include changes to business hours, phone numbers, service offerings, photos, and similar information. Requests for major structural redesigns or additional functionality beyond the original scope may be subject to additional fees, which will be communicated and agreed upon in advance.

Hosting and Uptime

We host all websites on Cloudflare Pages, a globally distributed content delivery network. While we strive for 99.9% uptime, we cannot guarantee uninterrupted service. Scheduled maintenance or force majeure events may occasionally affect availability. We are not liable for any losses resulting from website downtime.

Intellectual Property

Stock imagery used on Client websites is licensed for web use and remains subject to the terms of the original image licensor. The Client may not redistribute stock images independently of their website.

Limitation of Liability

Katahdin Digital Growth is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount paid by the Client in the 12 months preceding the claim. We are not responsible for the Client's business outcomes, search engine rankings, or lead generation results, though we build every site to maximize these outcomes.

Indemnification

The Client agrees to indemnify and hold harmless Katahdin Digital Growth from any claims, damages, or expenses arising from content provided by the Client, the Client's use of the website, or the Client's violation of any applicable laws.

Governing Law

These terms are governed by the laws of the State of Maine. Any disputes shall be resolved in the courts of Penobscot County, Maine.

Changes to These Terms

We reserve the right to update these terms at any time. Clients will be notified of material changes via email. Continued use of our services after notification constitutes acceptance of the updated terms.
